Ashtabula County Prosecutor, Colleen M. O’Toole with the assistance of Assistant Prosecutors, Christopher R. Fortunato and Christine Davis had successful results in the case of Louis K. Miller on August 14, 2023.

Defendant-Appellant Louis K. Miller appealed his convictions of two (2) counts of Rape, first Degree Felonies in violation of R.C. 2907.02(A) (b), and two (2) counts of Gross Sexual Imposition, third-degree felonies in violation of R.C. 2907.05(A) (4) in the Ashtabula County Court of Common Pleas.

The Court of Appeals of Ohio Eleventh Appellate District has affirmed the judgement of the Ashtabula County Court of Common Pleas.

After reviewing the weight of the evidence, The Court of Appeals of Ohio, Eleventh District cannot find that the jury was clearly lost its way and created such a manifest miscarriage of justice that the conviction must be reversed and a new trial ordered. Mr. Miller is currently serving thirty (30) years to life in prison with five (5) years post release control.
